Incest has historically been punished by governments as a way to deter offspring who have a high chance of being born with a serious birth defect. In Utah, it is punishable as a third degree felony, carrying up to five years in prison and up to $5,000 in fines.

Representative Merrill Nelson is sponsoring House Bill 75 to amend the definition of incest for purposes of judicial (and especially juvenile) enforcement. If passed, a sexual relationship between non-related step-siblings would be classified as incest, and thus sexual abuse.

HB 75 also prohibits a sexual relationship between non-related siblings through adoption, likewise classifying it as incest and sexual abuse.
